Terms of Use

Last updated: 30 October 2026, version 1.9

This is a translation for your convenience. The German version is legally binding.

These Terms of Use (the Terms, for short) set out what you may do on ipixvent, what we promise you and what happens if something goes wrong. We have written them so that you can read them without a lawyer. Every section begins with what it is about. Anything we do not tell you clearly does not apply against you (§ 6(3) KSchG [Austrian Consumer Protection Act]).

When you create an account, you enter into a contract with us on these Terms. So please read them first. You can find them at any time in the app under Settings → App and help → Terms of Use and at www.ipixvent.com/agb.

In short

1. Scope and contracting party

This section says who you are entering into the contract with, what it applies to and which documents belong to it.

1.1 Who we are

Your contracting party is ipixvent, Esentepe Mah. 960. Sokak No: 2/6, Melikgazi/Kayseri, Türkiye, ⟨company register number and company register court, if registered⟩, ⟨VAT ID number, if any⟩. In this text we call ourselves “ipixvent” or “we”. You can reach us at support@ipixvent.com and ⟨telephone number⟩. All details are also in the Legal Notice.

1.2 What these Terms apply to

These Terms apply to the ipixvent app on iOS and Android and to the website www.ipixvent.com. They do not apply to the internal admin interface admin.ipixvent.com; that is only for ipixvent staff.

ipixvent is aimed at people aged 14+ whose habitual residence is in Austria. If you use it as a consumer (that is, not for a business), the Consumer Protection Act (KSchG) applies to you. Where these Terms say something other than what the KSchG allows, the KSchG applies. If you use it as a business, for example as an organiser with company details or as an advertiser, the sections that expressly say so also apply.

1.3 Other applicable documents and order of precedence

These documents form part of your contract with us:

The Privacy Policy (www.ipixvent.com/en/datenschutz) informs you about how we handle your data. It is not a contract but information that the law requires us to give you.

If documents contradict each other, this order applies: for an individual Challenge, its participation terms take precedence, but only insofar as they do not allow anything that these Terms or the Community Guidelines prohibit. Otherwise these Terms take precedence.

1.4 Apple and Google

You download the app from Apple's App Store or from Google Play. For the download and for purchases in the stores, the terms of Apple Distribution International Ltd. (Ireland) or of Google Ireland Ltd. and Google Commerce Ltd. (Ireland) also apply. The contract for using ipixvent, however, exists only between you and us. In detail, this means:

Apple and Google are neither the organiser nor a sponsor of any Challenge or of the Season programme. This is also stated in every set of participation terms and in the Season programme terms.

1.5 How the contract is formed

The contract is formed when you create your account and, in doing so, confirm that you accept these Terms. We store which version you accepted and when, so that both sides can check it later. You can view and save every version of these Terms at www.ipixvent.com/agb.

German is the language of the contract. Translations in the app help you understand; the German text is binding.

2. Access and account

This section says who may use ipixvent, what applies to your account and how you register as an organiser.

2.1 Aged 14+, in Austria

You may use ipixvent if you are at least 14 years old (as of 20 September 2026; before that, 18). When you create your account, you enter your date of birth. We do not show it to anyone, and you cannot change it afterwards. If we have a well-founded suspicion that you are younger, we suspend the account until the question has been resolved. You can then contact support@ipixvent.com with proof. If the suspicion is confirmed, we delete the account.

If you are between 14 and 17, the following also applies: using ipixvent is free and is therefore a transaction you may enter into yourself at your age (§ 151(3) ABGB [Austrian Civil Code]). Your profile is private at first; you can change that. Purchases in the App Store or on Google Play are subject to the stores' rules and to the consent of your parents or guardians. Nothing that involves money — prize money, payouts, tickets, paid organiser tiers, ID verification — is open to you; that is 18+. Likewise, you can only create your own Challenges or register as an organiser from 18; joining, voting and commenting are open from 14.

2.2 One account per person, accurate details

Each person may have one account. Several accounts belonging to one person are not allowed, because they distort votes, leaderboards and the Season programme. Your details must be correct: email address, date of birth and, if you register as an organiser, the details you give there. You change organiser details, display name, bio and channels (Section 8.1) in the app. Email address and date of birth cannot be changed in the app; to change them, write to us at support@ipixvent.com from your account's email address.

An account is personal. You may not sell it, give it away or hand it over to anyone else. If one of your accounts has been suspended, you may not create a new one while the suspension lasts; we suspend any such account as well.

2.3 Account security

Keep your password secret and choose it so that nobody can guess it. You are responsible for what happens through your account while you are using it. If you notice that someone else has access, change your password immediately and contact support@ipixvent.com. We will help you get access back. You are not liable for damage that arises after you have informed us, and never for damage that is not your fault.

2.4 Signing in with Apple or Google

Instead of using a password, you can sign in with your Apple or Google account. We then receive an identifier from Apple or Google and, depending on your choice, your name and email address; we also ask for your username and date of birth. The security of your Apple or Google account is governed by their terms. What we process in this context is set out in the Privacy Policy.

2.5 Username, display name, Challenge names

Your username and your display name must not imitate anyone: no other person, no company, no authority, no brand that does not belong to you. Words that falsely suggest a role at ipixvent (such as “Admin”, “Support”, “ipixvent”) are blocked. We may change or reset a name if it infringes the rights of others, is misleading or violates the Community Guidelines. We let you know beforehand, unless the violation is obvious and urgent.

Organisers on the Orga Pro or Orga Max tiers can reserve Challenge names (Pro: up to 3, Max: up to 10). A reservation secures for you the name and all titles that begin with it within ipixvent. It is not a trade mark right and does not take away from anyone a title under which someone is already running a Challenge. A reservation remains in place until you release it in the app ⟨or: until a set period after the end of your tier has passed, once this process is built⟩; without a suitable tier you cannot reserve new names. If a reserved name infringes someone else's trade mark, we cancel it upon a report ⟨build the admin process⟩.

2.6 Registering as an organiser

Anyone who wants to organise a Challenge registers as an organiser in the app. You state whether you are acting privately or as a business, and give a public name, a contact email address, a telephone number and, for businesses, a contact person. The telephone number is required for registering as an organiser so that we can reach you quickly with questions about a Challenge or a prize. We use the telephone number and the contact person only for queries about your Challenges; we do not publish them and do not pass them on to participants.

Your public name and your contact email address appear in the participation terms of each of your Challenges. This is because you appear there as the party offering the prize, and participants must be able to reach you. The app tells you this before you submit your registration.

If you act as a business, you are a trader within the meaning of the law for your Challenges and events. The obligations in Section 6.7 then apply to you. If you act privately, you may still offer prizes from Orga Starter upwards; you are then personally responsible for them.

2.7 Check mark and ID verification

The check mark next to a name means: this person has verified their identity with an ID document and a face match with our service provider Didit, and the date of birth on the ID document is consistent with the age limit. Verification is voluntary. It is a requirement for the check mark and for the Orga tiers you buy in the store (Section 8.3). An ID document can belong to only one account; we reject a second account with the same ID document.

Verification runs automatically at Didit. If the result is negative, you can ask for a human to look at it and present your point of view: support@ipixvent.com. We may withdraw the check mark if it later turns out that the details are incorrect or that the account violates the rules (Section 9.3). What is stored during verification and what is not is set out in the Privacy Policy.

2.8 Age rating per Challenge

Every Challenge carries an age rating: 14+, 16+ or 18+. The organiser sets it when creating the Challenge and vouches that the task, entries and chat suit this rating (Community Guidelines, Section 15). Anyone who does not meet the rating does not see the Challenge — not in the overview, not in search, not on other people's profiles, not via a link — and cannot join it. A Challenge's chat follows its rating. Without an account, only what is open to ages 14+ is available. The rating can be lowered before the start; it can be raised only as long as nobody has joined.

ipixvent is currently built for Austria: events take place here, partners are based here, prizes are handed over here. We will expand this when we are ready and will then say so in a new version of these Terms.

3. What ipixvent provides and what may change

This section says what ipixvent can do, what we promise about availability and how we may change features.

3.1 What ipixvent is

ipixvent is a platform for video and photo Challenges. You can:

Basic use is free. We fund ipixvent through the paid services in Section 8 and through advertising that is labelled as an ad, appears in the feed and in Challenges and is not tailored to you (Section 10.3).

A Challenge's chat is a secondary feature of the Challenge, not a stand-alone messaging app. There are no direct messages between accounts.

3.2 Availability and maintenance

We do our best to keep ipixvent available at all times, but we do not promise uninterrupted availability. We announce maintenance in the app if it will take longer than a few minutes, and schedule it at night where possible. We cannot always prevent disruptions at our service providers (for example the video service or the stores); we fix them as soon as we can. For ongoing paid services, Section 3.5 applies.

3.3 Preview features

We may label new features as a preview or beta; this is then shown on the feature. Preview features may change or fail. This does not limit your statutory rights, including the warranty for paid services.

3.4 Changes to the service

We keep developing ipixvent. We may make minor changes that are objectively justified (security, legal situation, technology, changes at our service providers or at Apple and Google, improvements); they do not change the core of what you use. If we want to discontinue a feature or change it in a way that affects you adversely, we tell you at least 30 days in advance by email to your account address and in the app. For paid services: during a paid term, we do not take away anything you have bought. If a change affects a paid service more than minimally, you can terminate the contract for it free of charge within 30 days of the notification (§ 25 VGG [Austrian Consumer Warranty Act]); we refund you pro rata.

3.5 Warranty and updates

For services you pay for (Orga tiers, Creator Pass, One-off Pass, live packages), the statutory warranty under the Consumer Warranty Act (VGG) applies. We provide you with the updates necessary for the app to keep working as the contract promises, and tell you when you need to install an update. If you do not install it within a reasonable time, we are not liable for defects that are due solely to this. For free use, the statutory rules apply; we show advertising without analysing your data, so you do not pay for basic use with your data either.

4. Your content

This section says what happens to what you upload: it remains yours, and we may only show it.

4.1 The rights stay with you

Everything you upload or write (videos, photos, stories, texts, comments, chat messages, Challenge descriptions, logos) we call your content. It belongs to you. We acquire no ownership of it and no exclusive right to it.

4.2 What you allow us to do

So that we can show your content, we need your permission. You grant us a non-exclusive, free-of-charge, worldwide licence to use it (§ 24 UrhG [Austrian Copyright Act]) for these purposes:

“Worldwide” is there because the internet knows no borders and the video service caches content wherever it is accessed. We offer ipixvent only in Austria. You do not allow us anything more. In particular, we may not use your content in advertising for ipixvent (for example in store images, on the website or on social media) unless you separately consent to this for the individual entry. You can withdraw such consent at any time; we then remove the entry from the advertising as soon as this is technically possible.

4.3 What you allow others to do

Other users may view your content in the app, rate it, comment on it, see it in leaderboards and, if it is public, share it as a link. You do not thereby allow downloading or further use outside the app, and the app does not offer it either. A shared link to an entry leads to the Challenge; for a private Challenge, only people who have access to it can see it. Invitation links with an access code to private Challenges are sent only by the organiser.

4.4 What you allow the organiser to do

If you submit an entry to a Challenge, the organiser may, within the scope of the Challenge, view it, rate it, see it in the participant list and show it on site or in a live stream of the Challenge. Nothing more. If an organiser wants to use your entry elsewhere, for example in their own advertising, they need your separate consent. If the organiser's rules say otherwise, that does not apply. Any further use of your entry requires your separate consent outside of joining, for example a message from you to the organiser; accepting the participation terms when joining is not enough for this.

4.5 How long the permission lasts

The permission lasts as long as the content is on ipixvent. If you delete an entry, a video or your account, the content immediately becomes invisible to others. The files are placed in a deletion queue that is processed every 10 minutes; at the video service, removal from the cache can take up to a few minutes. Database backups are overwritten after at most 7 days. The permission then ends.

We may keep content longer only if we need it to review a reported violation, to comply with a statutory retention obligation, to comply with an order from an authority or to defend claims. In that case we keep it only as long as necessary for that purpose and do not show it publicly to anyone.

What others have already done with your content, such as comments under your entry, remains their responsibility; comments under a deleted entry disappear with it.

4.6 What you assure us

You only upload what you made yourself or what you have the necessary rights to. In detail, this means:

Anything copyright law permits without permission, such as quotations or parody within the statutory limits, remains permitted.

4.7 AI and editing

You label in the description any entries that were generated with artificial intelligence or edited so that they appear real. You do not need to label colour correction, cropping, filters with a recognisable style and the like. An organiser can exclude AI entries from their Challenge in the rules; they are then grounds for disqualification.

4.8 Music library

You use music from our library as the soundtrack of your entries on ipixvent. For sharing outside the app, there are two kinds of tracks:

For no track may you download, cut out, edit or use the song on its own outside your entry. The title and performer of the song used appear under every entry. If our licence for a track ends, we remove it from the library; entries that already use it remain unchanged, because the sound is part of your video file. If we have to remove an entry because of the music, we tell you so with reasons (Section 9.4).

4.9 Feedback

If you send us ideas, suggestions or bug reports, we may use them without payment. We do not treat them as confidential, but we do not name you without your consent.

5. Community Guidelines

The full Community Guidelines are at www.ipixvent.com/en/regeln and in the app. They are part of this contract. So that you do not have to look them up first, the most important prohibitions are listed here. They apply to everything you do on ipixvent: entries, stories, comments, chat, live streams, Challenge descriptions, names and profile pictures.

The following are not allowed:

Documentation, education, satire and art may stay, even if they would otherwise violate a rule. We then require context, such as a description or a note; if it is missing, we remove the entry. There is no exception for depictions of abuse or for terrorist propaganda.

What happens in the event of a violation is set out in Section 9.

6. Challenges and organisers

This section says who has which role in a Challenge, who answers for the prize and what applies to on-site events, Time Challenges and live streams.

6.1 Who has which role

A Challenge is created by an organiser. The organiser determines the theme, period, rules, scoring method and prize, runs the Challenge and hands over the prize. This makes the organiser the contracting party of the participants for this Challenge and, if there is a prize, the party offering it (§ 860 ABGB). ipixvent is the platform on which the Challenge takes place, and is neither organiser nor sponsor. Nor are Apple and Google. Claims arising from a Challenge, for example to the prize, are directed against the organiser.

We provide the technology: creating, submitting, rating, leaderboards, chat, notifications, the generated participation terms and the review in Section 6.4. We intervene in a Challenge if it violates these Terms, the Community Guidelines or the law.

6.2 Participation terms per Challenge

For each Challenge, the app generates participation terms from the organiser's details: who is organising, who may take part, what it costs (nothing), when what happens, how scoring works, what the prize is and what else applies. Added to this are the organiser's own rules. You see them on the Challenge before you join and accept them when you join. They supplement these Terms and must not contradict them (Section 1.3).

6.3 Taking part is free, no gambling

Taking part in a Challenge costs nothing. There is no way to buy or improve a chance of winning, with any amount. Who wins is decided by the scoring (Section 6.5), never by chance. A Challenge with a prize is therefore not gambling within the meaning of § 1 GSpG (Austrian Gambling Act). And even a prize competition with an element of chance would be exempt from the gambling monopoly if there is no stake (§ 4(5) GSpG). The app does not provide for prize draws among participants. If an organiser holds a prize draw outside the app, it is their own competition and their own responsibility.

Should we ever introduce participation fees, this would apply only after a new version of these Terms and only to Challenges whose scoring depends solely on performance.

6.4 Prizes

If an organiser offers a real prize, they must state its type, approximate value, provider and handover deadline and promise to answer for the prize. We review such Challenges before they go public: a human looks at the details and approves the Challenge or rejects it with reasons. The review checks whether the details are complete and plausible. It is no guarantee that the prize exists or will be handed over; the organiser is responsible for that.

The prize is not paid out in cash and is not exchanged. It must be handed over by the stated deadline. If a prize is not handed over, report it to us; we block organisers who do not deliver prizes from further Challenges with prizes. The promise they gave is recorded with its date in the Challenge's participation terms and remains viewable there.

6.5 Scoring and jury

Scoring uses one to five stars: by all signed-in people (community), by a named jury, by the organiser themselves, or by audience and jury at half each. At on-site events, the audience checked in at the door votes. The votes produce a weighted average: a few votes count for less than many, so that a single top score does not decide anything. Every vote is final. In the event of a tie, the earlier submission or the earlier joining decides.

Jury members are users whom the organiser invites and who accept. They do not rate their own entries and do not pass on their scores before scoring ends. The organiser does not take part in their own Challenge.

We remove votes that came about through manipulation (Section 5). The leaderboard then changes retroactively. XP in the Season programme are calculated, not booked, and fall accordingly.

6.6 What organisers see about participants

Anyone who runs or manages a Challenge sees the participant list: username, display name, status, time of joining, entry, number of ratings, average and warnings in this Challenge. This list can be exported as a file; it contains no email addresses and no account identifiers. At on-site events, the door also sees the ticket code, the amount, whether it has been paid and whether the person has checked in.

The organiser may use this data only to run the Challenge or event. Advertising, passing it on to third parties, combining it with other data sets or contacting participants outside the Challenge are not allowed. For what they do with exported data outside the app, the organiser is themselves responsible under data protection law and must comply with the GDPR, in particular by deleting the data after the Challenge ends. Violations lead to the organiser features being blocked.

6.7 Obligations of organisers

Anyone who creates a Challenge or an event undertakes the following:

If an organiser culpably breaches these obligations and we suffer damage as a result, for example because third parties assert claims against us, the organiser compensates us for this damage. You only compensate us for damage that is your fault, and only to the extent that it is based on your conduct; you are not liable for claims that arise without fault on your part or for damage we ourselves contributed to.

6.8 Safety: no dangerous tasks

A Challenge must not set a task that can only be completed at the risk of serious injury (Section 5, first point). We reject such Challenges, have them changed or end them. For tasks of a sporting nature: protective equipment and safety measures are part of the task, not an optional extra.

You take part in a Challenge on your own responsibility. You decide yourself whether you can perform a task safely. For damage resulting from performing a task, the organiser is liable under the law if they culpably set a dangerous task, and we are liable if we did not end an obviously dangerous task despite knowing about it. Otherwise we are not liable for what you do outside the app.

6.9 On-site events and tickets

An on-site event is a Challenge that takes place at a particular place and time. With a ticket in the app, you reserve a place with the organiser, as a participant or as a spectator. The ticket shows a code that is scanned at the door.

If admission costs something, you pay the organiser on site. ipixvent does not accept any money, is not the contracting party for admission and does not process any payment. The contract for admission is concluded between you and the organiser, at the latest at the door. If the organiser is a business, there is no right of withdrawal under the FAGG for leisure events with a fixed date (§ 18(1)(10) FAGG); you can still cancel your spectator reservation in the app at any time as long as you have not yet checked in. If you do not show up, the place lapses. If the event is cancelled or postponed, the organiser informs you; any claims arising from this are directed against the organiser.

On site, the organiser's house rules apply. Safety, permits, youth protection and compliance with regulations at the venue are the organiser's responsibility. Anyone filming or taking photos at an event must inform the guests and comply with the right to one's own image and the GDPR. You can also report incidents at an event in the app.

6.10 Time Challenges

Time Challenges run in rounds with deadlines. For each round, you submit a video by the deadline. The videos of a Time Challenge are automatically deleted 7 days after the Challenge ends; the result and the leaderboard remain. The operator can set this period to between 1 and 365 days; the current value is in the Privacy Policy.

6.11 Live streams

Organisers can stream a Challenge live. Whoever streams is responsible for everything that can be seen and heard in the stream, including guests and music. The Community Guidelines apply in real time. If a stream violates the rules, we end it; if this happens again, we block the live feature. Within the booked airtime you can pause the stream and resume it; once the airtime has run out, it can only continue with a purchased extension. The streaming provider records it. The recording is not shown in the app; it remains with the provider ⟨retention period at the live provider; deletion when the Challenge is deleted, once built⟩. What live streams cost is set out in Section 8.5.

6.12 Managers

Depending on the tier, an organiser can give other accounts roles in their own Challenge: management, moderation, door. These people act on behalf of the organiser. Responsibility for the Challenge and for the prize stays with the organiser; purchases and revenue stay with the account that owns the Challenge. Managers may use the data from Section 6.6 only as described there.

6.13 Moderation by organisers

Within their own Challenge, the organiser can warn, disqualify or block participants, delete chat messages, hide comments under entries in their own Challenge or mute people. Every action needs a reason, which the app shows to the person affected. Exclusion from a Challenge is not the same as a suspension on ipixvent: it only takes effect in that Challenge. If you think an action is arbitrary, report it to us; we check whether the organiser treated people equally and gave reasons, and otherwise intervene.

7. Season programme

The Season programme is a loyalty programme of ipixvent. The organiser of the programme is the operator of the app, not the organiser of an individual Challenge and not the partner granting a perk. The Season programme terms apply; they are in the app with the programme and form part of this contract. The key points:

8. Paid services

This section says what things cost, where you buy them, how you cancel and when you can withdraw.

8.1 Overview and prices

All prices are final prices in euros ⟨including VAT / note on the small business scheme⟩. They are shown before every purchase in the app or in the store. As of this version:

The exact limits of each tier are shown in the app in the tier comparison. They may change in new versions of these Terms; for an ongoing paid term, Section 3.4 applies.

8.2 Subscriptions via the App Store and Google Play

As of this version: purchasing the Creator Pass, Orga tiers and the One-off Pass via the stores has not yet been enabled. Until then, the ipixvent team assigns tiers and passes on request to support@ipixvent.com; for tiers assigned in this way, ID verification is not a requirement (the ipixvent team vouches for you). As soon as store purchases are available in the app, Sections 8.2 to 8.4 apply as described; we will tell you in the app and raise the version of these Terms.

Creator Pass and the Orga tiers Starter, Pro and Max are subscriptions with a term of one month. You buy them in the App Store or on Google Play. There you see the price, term and renewal before you buy. The following applies:

Tiers are tied to your account. Managers you assign to a Challenge do not need their own subscription.

8.3 ID verification as a requirement for purchased Orga tiers

The Orga tiers Starter, Pro and Max that you buy in the store require ID verification under Section 2.7. The reason: anyone who offers prizes and collects admission should be a verifiable person for the participants. The app will tell you this before you buy. Until you have passed verification, the tier's organiser features are not yet available to you; until then you can only do what Orga Free allows. The Creator Pass included in the tier applies from the purchase.

If you do not pass verification for reasons you are not responsible for, if the number of verifications for the month has been used up, or if you do not want to do the verification, you can claim back the fee for each period in which you could not use the tier's organiser features for this reason: write to support@ipixvent.com. We arrange the refund via the store; if the store does not refund within 30 days, we refund the amount to you ourselves. Also cancel the subscription in the store so that it does not continue. In justified cases, we enable a tier without ID verification after our own review; ask us about it. The number of ID verifications per month is limited; the app shows you when the limit has been reached.

8.4 One-off Pass

With the One-off Pass, you buy in the store the right to organise a single Challenge with the features of Orga Pro without taking out a subscription. The pass is valid for 90 days from purchase and is used up as soon as you create the Challenge with it. Section 8.2 applies to payment and withdrawal. If you redeem the pass within 14 days of purchase, this is only possible if you have first agreed and confirmed that your right of withdrawal thereby expires; the app will tell you this before you redeem it. After it has been used or after the 90 days have expired, it cannot be returned.

8.5 Live packages via Stripe

You buy live packages directly from us. Payment is made by card via the payment service provider Stripe Payments Europe Ltd. (Ireland); Stripe collects your card details and your email address itself, and we do not see any card details. The Distance and Off-Premises Contracts Act (FAGG) applies to this purchase. Before you buy, we show you the package, the viewer limit, the airtime of up to 4 hours, the price and the Challenge the package applies to ⟨and your rights, once the withdrawal information is in the app⟩. By tapping “Pay now” in the app and completing payment at Stripe, you place an order with an obligation to pay. After payment, the app shows you the booking as paid; ⟨decision, to be built before publication: we confirm the purchase by email to your account's address with the package, price, Challenge, this withdrawal information and, if you agreed to the early start, your consent (§ 7(3) FAGG) / the Stripe checkout sends you a receipt⟩.

A live package belongs to the Challenge for which you buy it. You start the stream for your event; the booked broadcast window begins with the first transmission, at the earliest at the time of the Challenge. You buy a 60-minute extension separately at the price shown to you beforehand; there is no additional charge afterwards. We agree packages for more than 5,000 viewers individually.

Right of withdrawal. You can withdraw from this purchase within 14 days without giving reasons. The period begins on the day the contract is concluded, i.e. with the order. To withdraw, send us a clear statement, for example an email to support@ipixvent.com. You can use the model withdrawal form below, but you do not have to. It is sufficient to send the statement before the period expires. If you withdraw, we refund all payments we have received from you without undue delay and at the latest within 14 days of the day your withdrawal reaches us. We use the same means of payment that you used for the purchase; you will not be charged any fees for this.

When the right of withdrawal expires. If you start the live stream before the 14 days are up, you are thereby requesting that we begin the service early. The right of withdrawal expires when the stream has been fully provided, i.e. when the booked airtime has run out or the stream has ended, and you have previously expressly agreed and confirmed that you thereby lose your right of withdrawal. You give this consent ⟨when fetching the stream details in the app, once this step is built⟩. If you withdraw after the start but before the end, you pay the share corresponding to the service provided (§ 16 FAGG). ⟨Law firm: confirm classification as a service (§ 18(1)(1) FAGG) or digital content (item 11)⟩

A live package you do not use remains on the Challenge until you remove it or delete the Challenge; ⟨rule for refunding unused packages⟩. If you delete the Challenge, the purchase remains in our books so that we can document it to you and to the tax office.

Withdrawal (Rücktritt) and revocation (Widerruf) mean the same thing here; the law uses the term Widerruf in the form's name. You can use it for live packages and for purchases via the App Store; with Google Play, you declare your withdrawal in the Play Store (Section 8.2).

Model withdrawal form (withdrawing from a purchase from us)

(If you want to withdraw from the contract, fill in this form and send it to us.)

To ipixvent, Esentepe Mah. 960. Sokak No: 2/6, Melikgazi/Kayseri, Türkiye, support@ipixvent.com:

I hereby withdraw from the contract I concluded for the purchase of the following service (live package, subscription, One-off Pass): ______________________
Ordered on: ______________________
Name: ______________________
Address: ______________________
Date, signature (only if notified on paper): ______________________

8.6 Invoices, records, taxes

For purchases in the store, you receive the invoice from Apple or Google. For live packages, we issue you an invoice on request to support@ipixvent.com ⟨until sending by email is built; after that: you receive the invoice from us by email to your account's address⟩. We keep records of purchases for 7 years (§ 132 BAO [Austrian Federal Fiscal Code]), even if you delete your account. If you are a business and need an invoice with a VAT ID, let us know before the purchase.

8.7 Advertisers and partners

Anyone who places ads on ipixvent or offers perks in the Season programme as a partner concludes a separate contract with us. These Terms do not apply to that. Advertisers receive no personal data of users, only figures on how often their ad was shown and tapped.

9. Moderation, reports and sanctions

This section describes how we review content and what we do when someone breaks the rules. It fulfils our obligations under the Digital Services Act (Regulation (EU) 2022/2065, DSA for short).

9.1 How we review

We do not monitor content generally and in advance; the law does not require this of us and it would not be appropriate towards you (Art. 8 DSA). We review content when it is reported, when a Challenge with a real prize has to be approved before publication, and when we have cause to, for example irregularities in votes or tips from outside. We carry out random checks without specific cause ⟨not at all / to the following extent: …⟩. Every decision about content or an account is made by a human from our team.

We do not currently use automatic content filters that scan videos, photos or texts for prohibited content. Only technical limits run automatically: a maximum number of votes per day that count in the Season programme, one report per person and target, a brake on too many failed attempts with access codes, length and format limits when uploading, and ID verification at our service provider (Section 2.7). If we use automated tools later, we will say so in a new version of these Terms.

We apply restrictions diligently, objectively and proportionately, taking into account the rights of everyone involved, in particular freedom of expression (Art. 14(4) DSA).

9.2 Reporting

You can report entries, comments, profiles, chat messages and Challenges in the app: via the “Report” menu on the content concerned. You choose a reason (Violence, Hate or insults, Sexual content, Spam or fraud, Copyright infringement, Pretending to be someone else, Something else) and can add a note; for “Something else” the note is mandatory. For a report by email to support@ipixvent.com we need: which content you mean (link or description), why it is illegal or breaks the rules, your name and email address (not needed for reports of child sexual abuse or sexual exploitation of children and depictions of it; you can report those anonymously), and a statement that your information is correct to the best of your knowledge (Art. 16 DSA).

We confirm receipt, review the report promptly, with priority for obviously criminal content, and tell you our decision. The reported person does not find out who reported them. A report is not a weapon: knowingly false, duplicate or obviously unfounded reports are themselves a breach of the rules (Section 9.7).

9.3 What we can do

If we find a violation of these Terms, the Community Guidelines or the law, we may, depending on severity and repetition:

We choose the mildest action that ends the violation. As a rule, we warn you beforehand and give you the opportunity to remedy the violation. This does not apply if the violation is so serious that we have to act immediately (for example in the case of violence, depictions of abuse, fraud), or if it cannot be remedied.

9.4 Statement of reasons

If we remove content or take action against your account, we tell you without undue delay in the app (Art. 17 DSA); in the case of an account suspension, we also write to you by email at your account's address, because you can then no longer open the app. We tell you:

The statement of reasons is omitted only if a law prohibits it or if it concerns mass, obviously misleading spam.

9.5 Complaints about our decision

If you disagree with an action, or if we did nothing in response to your report, you can complain free of charge within six months of our notification: by email to support@ipixvent.com with the subject “Complaint” and the reference from our notification. A human, where possible a different person from the one who made the decision, reviews the case afresh and replies to you without undue delay. If the action was not justified, we reverse it and restore the content or the account. We give reasons for this too.

9.6 Out-of-court dispute settlement

If the decision stands, you can turn to an out-of-court dispute settlement body certified under Art. 21 DSA. A list is kept by the Digital Services Coordinator in Austria, KommAustria (the Austrian Communications Authority, www.rtr.at). We are currently not obliged to take part in such proceedings ⟨decision: and take part voluntarily / and do not take part⟩. Your route to the courts remains open in any case. You can also complain to KommAustria if you believe that we are in breach of the DSA (Art. 53 DSA).

9.7 Repeated violations and misuse of the reporting function

Anyone who, after a warning, continues to post content that is obviously illegal or breaks the rules is suspended for 30 days; if it happens again, permanently. If someone repeatedly sends obviously unfounded reports or complaints, we do not process their reports and complaints for 30 days. We decide this based on the number of cases, their share of all the person's reports or content, the severity and the recognisable intent, and announce it beforehand (Art. 23 DSA).

9.8 Authorities

We comply with orders from courts and authorities to act against content or to provide information if they meet the legal requirements (Art. 9, 10 DSA). If we become aware of content that gives rise to a suspicion of a criminal offence against the life or safety of persons, we report this to the law enforcement authorities (Art. 18 DSA). We remove terrorist content within one hour of an order from an authority (Regulation (EU) 2021/784).

9.9 Points of contact

Our point of contact for users (Art. 12 DSA): support@ipixvent.com and in the app under Settings → App and help → Help and contact. A human replies there, not just a program. Our point of contact for authorities of the Member States, the European Commission and the European Board for Digital Services (Art. 11 DSA): support@ipixvent.com, as in the Legal Notice. We communicate in German and English.

10. Ranking, recommendations and advertising

This section says how the lists in the app are sorted, what the “Featured” strip is and how advertising works.

10.1 How lists are ranked

We do not build an interest profile of you and do not learn from your viewing behaviour. The lists in the app are ranked as follows:

10.2 The “Featured” strip

The “Featured” strip shows Challenges from organisers on the Orga Pro (1 place) or Orga Max (3 places) tiers. The place belongs to the tier. So it is a paid placement and not an editorial selection; the app tells you this at the strip. The order within the strip changes daily for each viewer, so that the same Challenge is not permanently at the front. Places in the strip are not sold individually.

10.3 Advertising

In the feed and in Challenges, we show ads from advertisers. Every ad is labelled “Ad” and names who paid for it. Ads are not selected based on what you watch or who you are: we show active campaigns in the booked period, by priority and otherwise at random, without target groups, without location and without a profile. Advertisers do not find out who you are. Your name, your picture and your entries do not appear in advertising. With the Creator Pass, you do not see any ads.

10.4 Paid entries

If you receive money or a benefit from someone for an entry, you label it as advertising in the description (§ 6 ECG, § 26 MedienG [Austrian Media Act] by analogy, UWG). If the label is missing, we require it or remove the entry. A Challenge's prize carries the note “Provided by” if someone other than the organiser provides it; that is how the sponsor is labelled.

11. Rights in the platform and infringements

This section says what belongs to us and how you report an infringement or defend yourself against a report.

11.1 What belongs to us

The app, the website, their design, their texts, their source code, the ipixvent brand, the logo and the music library belong to us or our licensors. You receive a personal, non-transferable right to use the app and the website for your own use, as described in these Terms. You may not copy, modify or reverse-engineer the app or circumvent its protection mechanisms, unless the law expressly permits this (§ 40d, § 40e UrhG). You may not use the brand and the logo without our written consent; mentioning “on ipixvent” in your own entries is allowed.

11.2 Reporting infringements

If you believe that content on ipixvent infringes your copyright, your trade mark rights or your right to your own image, report it in the app with the reason “Copyright infringement” or by email to support@ipixvent.com. We need: the content (link or description), the work or right being infringed, proof that you are entitled (author, rights holder or their representative), your name and email address, and a statement that your information is correct. We review promptly, remove the content if the report is substantiated, and inform the person who uploaded it, with reasons (Section 9.4).

11.3 Counter-notice

If your content was removed because of an infringement and you think that was wrong, for example because you hold the rights or a statutory exception applies, send us a counter-notice at support@ipixvent.com: the content, why the removal is unjustified, your name and email address. We forward it to the person who reported it without disclosing your email address, unless you allow it, and decide afresh. If the reporting person does not provide proof within 14 days that they have taken legal action, we restore the content if, after our review, it is not obviously infringing. The procedure under Section 9.5 is also open to you.

11.4 Repeated infringements

Anyone who repeatedly infringes the rights of others is suspended. What “repeatedly” means is determined by Section 9.7. You may not upload content again that we removed because of an infringement, not even in modified form or via another account; that counts as a further infringement.

12. Term and termination

This section says how long the contract runs, how you end it and when we may do so.

12.1 Term

The contract for free use runs for an indefinite period. Paid services have the term set out in Section 8.

12.2 Termination by you

You can terminate at any time by deleting your account: in the app under Settings → Delete account, or via www.ipixvent.com/en/konto-loeschen. The app first shows you what will be deleted along with it, and asks you to type the word LÖSCHEN. After that:

What remains: what we are legally required to keep (records of purchases, 7 years), entries in our admin log about actions taken against your account (without a link to your deleted account, 3 years), archive entries on live purchases, and used perk codes from the Season programme (not assigned to you). Details are in the Privacy Policy.

12.3 Termination and suspension by us

We may terminate the contract for free use with ordinary notice of 4 weeks if we have an objective reason, for example if we discontinue ipixvent or a feature. We tell you the reason. Paid terms run to their end or are refunded pro rata.

We may suspend your account or terminate the contract without notice if:

For every suspension and every termination, Section 9.4 (statement of reasons) and 9.5 (complaint) apply. As a rule, we announce them beforehand so that you can comment, unless that would defeat the purpose of the action. If we permanently suspend your account because of a culpable violation, we refund you, pro rata, the fee for the remaining term of a service bought from us that you can no longer use. We may deduct from this the damage that your violation has demonstrably caused us. For store subscriptions, the store refunds according to its rules; we help you with a confirmation of the suspension if the store requires one.

12.4 What continues to apply after the end

After the contract ends, the following continue to apply: Section 4.5 (end of the permission), 4.6 and 14 (responsibility for content), 8.6 (records), 13 (liability), 16 (law and jurisdiction) and 18 (final provisions).

13. Liability and warranty

This section says what we answer for and what we do not.

13.1 What we are liable for

We are liable under the law for damage we cause intentionally or through gross negligence, and for personal injury in every case. We are not liable for slight negligence, except in the case of personal injury or where the law makes liability mandatory (§ 6(1)(9) KSchG). This also applies to our staff and vicarious agents.

13.2 Other people's content

We are not liable for content that users upload as long as we have no knowledge of its illegality and, as soon as we become aware of it, act promptly (Art. 6 DSA). The fact that we carry out voluntary reviews does not change this (Art. 7 DSA). We do not guarantee that entries, Challenge descriptions, organisers' rules or partners' details are correct, complete or lawful.

13.3 Prizes, events, perks

For handing over a prize, running an event and a partner's performance in the Season programme, whoever promised it is liable: the organiser or the partner, as the case may be. We act as an intermediary. We are only liable if we ourselves have breached an obligation under these Terms, for example by obviously failing to carry out the review under Section 6.4, and only within the scope of Section 13.1.

13.4 Availability and preview features

We are not liable for outages whose cause lies outside our control (outage of the App Store or Google Play, of the internet, of your device, force majeure). We are liable for service providers we use to perform our obligations, such as the video service or the database provider, as we are for ourselves, within the scope of Section 13.1. We are not liable for announced maintenance if we announced it in the app at least 24 hours in advance and it does not last longer than announced. Nothing different applies to preview features (Section 3.3); their labelling does not exclude liability, it only tells you what you can expect.

13.5 Warranty

The statutory warranty (Section 3.5) is not affected by this section. We do not exclude it and do not shorten it.

14. Responsibility for your content

You are responsible for what you upload, write and stream on ipixvent. If content of yours infringes the rights of others, their claims are directed against you. We help to clarify matters to the extent the law requires of us, and only hand over data if a court or an authority orders it or the law provides for it.

If a claim is made against us because of content of yours and you committed the infringement culpably, you compensate us for the damage this causes us, including reasonable costs of legal defence. We inform you of the claim without delay, coordinate with you and do not acknowledge anything without your consent. You only compensate us for damage that is your fault, and only to the extent that it is based on your conduct; you are not liable for claims that arise without fault on your part or for damage we ourselves contributed to.

15. Changes to these Terms

This section says when and how we may change these Terms and what you can do then.

15.1 When we may make changes

We change these Terms only for these reasons:

15.2 How a change works

We notify you of a change at least two months before the day on which it takes effect: in the app and by email to your account address, with the new text, a comparison of the changed passages and the date. In the notification, we point out that the change will apply if you do not object to it by that day, and that you can object and terminate.

If you object, the previous version continues to apply to you. We may then terminate the contract for free use with ordinary notice (Section 12.3, notice period 4 weeks) if we can no longer objectively offer the old version; we then tell you the reason. You can terminate yourself at any time (Section 12.2). Paid terms run to their end on the old terms; you cancel store subscriptions in the store. If you do not object, the new version applies from the stated day.

15.3 What never happens without your active consent

We never use this procedure to change: the main service you pay for, the fee for an ongoing paid service, the scope of the permission for your content (Section 4.2) to your disadvantage, or the law applicable to this contract. Such changes require your express consent in the app or in the store. Without it, the old version continues to apply to you, or the contract ends with the current period.

15.4 Significant changes to the rules

We announce significant changes to the Community Guidelines or to the moderation procedures (Section 9) in the same way (Art. 14(2) DSA). Changes that only benefit you, or that cannot be postponed because of a security vulnerability or a legal obligation, may apply immediately; we then tell you why.

16. Applicable law and place of jurisdiction

This contract is governed by Austrian law. The UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law are excluded. If you are a consumer and your habitual residence is in another state of the European Economic Area, the mandatory consumer protection provisions of that state remain unaffected (Art. 6(2) Rome I Regulation).

If you are a consumer, the statutory place of jurisdiction under § 14 KSchG applies to claims against you: the court in whose district you have your residence, habitual residence or place of employment. You can sue us at our registered office or, where the law provides for it, at your place of residence. If you are a business, the court with subject-matter jurisdiction in ⟨operator's registered office⟩ has exclusive jurisdiction.

17. Dispute resolution

If you have a problem, write to us first: support@ipixvent.com. Most questions can be resolved this way. For complaints about moderation decisions, Section 9.5 applies; for out-of-court bodies under the DSA, Section 9.6.

We are not obliged and ⟨not willing / willing⟩ to take part in dispute resolution proceedings before a consumer arbitration body under the Alternative Dispute Resolution Act (AStG). ⟨If willing: the competent body is the Internet Ombudsstelle, Ungargasse 64-66/3/404, 1030 Vienna, www.ombudsstelle.at.⟩ The European Commission's former online dispute resolution platform was shut down on 20 July 2025; it no longer exists. The route to the ordinary courts is always open to you.

18. Final provisions

This section contains the rules that apply to the whole contract: language, versions, transfer to another company, validity.

18.1 Language

These Terms are written in German. German is the language of the contract and the language in which we communicate with you; English is also possible. Translations in the app are there to help you understand; in the event of discrepancies, the German text prevails.

18.2 Storage and versions

We do not store the contract text for you, apart from the version and the time of your acceptance. You can view, print and save these Terms at any time at www.ipixvent.com/agb. Each version carries a version number and date; earlier versions can be found at www.ipixvent.com/agb/archiv ⟨create the archive⟩.

18.3 Transfer to another company

If another company takes over ipixvent as a whole, we tell you at least two months in advance by email and in the app and name the company. Your contract passes to that company only with your consent; we ask you about this in the app. If you do not consent, your contract ends on the day of the transfer, and paid terms are refunded pro rata. You may not transfer your rights under this contract, because the account is personal.

18.4 If a clause is invalid

If a provision of these Terms is invalid, the rest remains valid. The invalid provision is replaced by the law. No supplementation to your disadvantage takes place.

18.5 Promises and waiver

Promises we make to you apply even if they are not in these Terms. We only ask you to have important promises confirmed by email so that both sides can read them later. If we refrain from exercising a right on one occasion, that does not mean we give it up.
